Introduction
Welcome to ZUKO Ltd.'s website. These Terms of Service ("Terms") govern your use of the ZUKO website and any purchases or services through it. ZUKO Ltd. ("ZUKO", "we", or "us") is a company incorporated under Swiss law (registered office: World Trade Center, Av. Gratta-Paille 2, 1018 Lausanne, Switzerland). By accessing our site or placing an order, you agree to these Terms, which form a binding agreement between you and ZUKO. Please read them carefully before using the site or making a purchase. If you do not agree, you should not use our website or services.
Eligibility and Age Restrictions
You must be at least 18 years old (the age of majority in Switzerland and most EU countries) to use this site or purchase products. If you are under 18, you may only use the site with the involvement and consent of a parent or legal guardian (in many jurisdictions, contracts by minors are valid only with guardian consent). We do not knowingly allow minors to make purchases or enter into contracts on this site. Furthermore, certain products or services may have additional age restrictions based on regional laws (for example, higher age limits in specific jurisdictions); you must comply with all age-related laws applicable in your country or state. By placing an order, you confirm that you meet the required age and have full legal capacity to enter into a contract.
Product Information and Orders
ZUKO will make reasonable efforts to ensure that product descriptions, pricing, and availability information on our website are accurate and up to date. However, minor errors or discrepancies may occur, and we reserve the right to correct any errors and to update information at any time.
Placing an Order
To purchase a product, you must follow the online ordering process. You will have the opportunity to review and correct any input errors (e.g. adjust quantities, enter shipping details) before finalizing your order, as required by law. When you click a button to confirm your purchase (such as "Buy" or "Place Order"), you are making an offer to buy the selected product(s) under these Terms. Under Swiss law and similar EU e-commerce rules, a sales contract can be concluded electronically with a simple click of the purchase button. Once your order is submitted, we will promptly send you an order receipt/confirmation by email. This confirmation email means we have accepted your order, at which point a binding contract is formed.
Order Acceptance and Cancellation
We reserve the right to decline or cancel any order for legitimate reasons (for example, if a product is out of stock, if we suspect fraud, or if you are in a region we do not ship to). If we cancel your order, we will notify you and provide a refund if you have already been charged. You may cancel your order before it has shipped by contacting us, except for orders of goods made-to-order or other items not eligible for cancellation (see Returns and Right of Withdrawal below for post-purchase cancellation rights).
Pricing and Payment
All prices on our site are provided in the currency indicated (e.g. CHF, EUR, USD) and are inclusive of any value-added tax (VAT) or sales taxes where required by law, unless stated otherwise. We comply with applicable pricing laws, including Swiss and EU requirements to clearly display the total price including taxes and any mandatory charges. Shipping fees or other additional costs (if any) will be shown before you complete an order. We strive to ensure that pricing information is correct; if an obvious pricing error is discovered, we will contact you for instructions or cancel the order and refund any payment, at our discretion.
You can pay using the payment methods offered at checkout (such as major credit/debit cards or other electronic payment services). Payments are processed via reputable third-party payment processors, and we do not collect or store your full payment card details on our own systems for security. By submitting payment information, you represent that you are authorized to use the chosen payment method and authorize us (or our processor) to charge the full order amount, including any applicable taxes and shipping, to that payment method.
If your order is shipping to a country outside of our main fulfillment region, you (the customer) are responsible for any import duties, customs fees, or local taxes that may apply upon delivery, unless we explicitly state that such fees are covered. We have no control over these government-imposed charges and cannot predict their amount. Please check your country's import rules if you are unsure.
Shipping and Delivery
Service Regions
ZUKO currently ships products only to the following countries: Switzerland, United Kingdom, Germany, Austria, Italy, Portugal, and United States of America. We do not ship to other countries at this time. Orders with a delivery address outside the above regions will not be accepted or processed.
Delivery Times
We will inform you of the estimated shipping timeframe during checkout or in the order confirmation. While we aim to dispatch orders promptly, delivery times can vary depending on destination. There is no absolute maximum delivery period set by Swiss law, but we will provide a reasonable estimate and keep you updated. If delivery is delayed beyond a reasonable time, you may contact us for assistance. We are not liable for delays caused by events outside our control (e.g. customs clearance delays, carrier issues, natural disasters).
Title and Risk
Title to the products and risk of loss or damage pass to you upon delivery of the goods to the address you provided (or upon handover to you by the courier). It is your responsibility to ensure the accuracy of the shipping address and to receive the package. If a package is returned to us due to an incorrect address or failure to collect, we may contact you to arrange reshipment (additional shipping fees may apply).
Delivery Confirmation
In compliance with e-commerce best practices, we will send an electronic confirmation when your order has been shipped, and in some cases the carrier may provide tracking information. Upon receiving your order, please check the products for any damage or defects and notify us promptly of any issues.
Returns and Right of Withdrawal
We want you to be satisfied with your purchase. If for any reason you change your mind about a product you bought, eligible customers may return items under the conditions below:
EU/EEA & UK Consumers — 14-Day Cooling-off Period
If you are a consumer in the European Union, European Economic Area, or the United Kingdom, you have a legal right to withdraw from the purchase within 14 calendar days after you receive the goods, without giving any reason. This is your statutory "cooling-off" period under EU/UK consumer protection laws. To exercise this right, you must inform us of your decision to cancel within the 14-day period. We will provide instructions for return. You then must send back the products within 14 days of notifying us of cancellation. We will issue a refund for the product price (and any standard shipping cost) within 14 days of receiving the returned goods (or of receiving evidence that you have sent them back), provided the goods are returned in unused, resalable condition.
Exceptions
The 14-day withdrawal right does not apply to certain types of products, such as sealed goods that were unsealed after delivery and not suitable for return for health/hygiene reasons, perishable goods, made-to-order or personalized items, digital content that has been accessed, etc. We will inform you at purchase if any item is non-returnable due to these exceptions.
Swiss & Other Customers
Under Swiss law, there is no automatic right of return or cancellation once an online order is placed. However, ZUKO will voluntarily offer a 14-day return policy for customers in Switzerland and any other regions we serve (same 14 days from delivery) in line with our commitment to customer satisfaction and consistent service. This voluntary return policy is subject to the same conditions described for EU returns (items must be in new condition, etc.), and it does not affect any rights you may have regarding defective products (see Warranty below).
Return Process and Costs
To initiate a return or withdrawal, please contact our customer support (see Contact Information below) with your order details and a statement of your decision to cancel/return. We will provide you with return instructions, including the return address. Unless the product was defective or we made an error, you will be responsible for the cost of return shipping. We recommend using a trackable shipping method for your return. Once we receive and inspect the returned product to confirm it is in acceptable condition, we will process your refund. Refunds will be credited to the original payment method used for the purchase. Please note that initial shipping fees (if any) may not be refundable except where required by law or where we choose to refund them as a courtesy.
Warranty and Defective Products
All products sold by ZUKO are covered by the legal warranty against defects as mandated by applicable law. Under Swiss law (Article 210 of the Swiss Code of Obligations) and EU consumer law, buyers have up to two years from delivery to report products that are defective or not as described. This means if an item you purchased from us is faulty, malfunctions, or does not conform to its advertised specifications, you are entitled to a remedy. Depending on the situation and local law, the remedy may include repair, replacement, or a refund. We may first offer to repair or replace the item; if that's impossible or fails, you can request a refund of the purchase price.
This statutory warranty does not cover damage caused by misuse, improper handling, or normal wear and tear. It also does not cover issues arising from failure to follow the product instructions. To make a warranty claim, please contact us as soon as you discover a defect and provide details of the issue. We may require proof of purchase (e.g. your order number) and may ask for photos or return of the item for inspection. If a defect is confirmed, we will fulfill our warranty obligations in compliance with the law and at no cost to you (any shipping costs for returning a faulty product to us will be reimbursed, and we will cover the cost of shipping any repaired or replacement item back to you).
In addition to the mandatory legal warranty, any manufacturer's warranty or additional guarantee will be detailed on the product page or documentation if offered. Such commercial guarantees are extra and do not limit your core rights to the 2-year defect guarantee, which we cannot exclude or reduce for EU consumers.
Limitation of Liability
Use of Site
We strive to provide accurate information and a secure experience, but your use of the website is at your own risk. The site and its content are provided on an "as is" and "as available" basis, without any express or implied warranties except as stated in these Terms. To the fullest extent permitted by applicable law, we disclaim all other warranties, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. That said, nothing in these Terms affects any warranties or legal remedies that cannot be disclaimed or limited by law — for example, the statutory warranty for defective products mentioned above or any mandatory consumer protections in your jurisdiction.
General Liability
To the extent allowed by law, ZUKO and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or in connection with your use of our site or purchase of products. In no event shall our aggregate liability for any claims arising from your use of the services or purchase of products exceed the amount you paid to us for the product or service in question. This limitation of liability applies whether the claim is based on warranty, contract, tort (negligence included), or any other legal theory.
Exceptions
We do not exclude or limit our liability for gross negligence, willful misconduct, fraud, or personal injury or death caused by our negligence, or any other liability that cannot be excluded under law. Some jurisdictions (for example, certain U.S. states) do not allow the exclusion of certain warranties or the limitation/exclusion of certain damages; in such jurisdictions, our liability will be limited to the maximum extent permitted by law.
Compliance with Laws and Export
You agree to use our products and services only for lawful purposes and in compliance with all relevant laws. Given that we currently ship only to specific countries, you must not export or re-sell our products to countries or persons prohibited by export control laws or sanctions. If any regulatory approvals or certifications apply to our products, we will provide them as required; however, it is your responsibility to use products in conformity with local regulations (e.g. electrical standards, age-restricted product rules).
Privacy and Data Protection
Your privacy is important to us. Our collection, use, and disclosure of personal information in connection with the website and your orders are described in our Privacy Policy (see below). We handle personal data in accordance with applicable data protection laws, including the EU General Data Protection Regulation (GDPR) and the Swiss Federal Act on Data Protection (FADP), which set strict standards for privacy and security. By using the site or placing an order, you acknowledge that you have read our Privacy Policy and consent to our handling of your information as described therein. Governing Law and Jurisdiction
These Terms and any dispute arising out of your use of the site or purchase of products shall be governed by the laws of Switzerland, without regard to its conflict of law principles. We specifically exclude the application of the United Nations Convention on Contracts for the International Sale of Goods (CISG), if otherwise applicable. By using this site or buying products, you agree that any disputes that cannot be amicably resolved will be submitted to the exclusive jurisdiction of the competent courts in Lausanne, Switzerland (or the court applicable to our registered office).
Consumer Protection Note: If you are a consumer residing in the EU/EEA or another country with consumer protection laws, this choice of Swiss law will not deprive you of the mandatory protections afforded under the laws of your country of residence. In other words, regardless of the governing law stated, you are still entitled to any non-waivable consumer rights under your local law. Likewise, any right or remedy granted to you by applicable law is in addition to those outlined in these Terms.
Changes to These Terms
We may update or modify these Terms from time to time, for example to reflect changes in our services, legal obligations, or for other operational reasons. When we update the Terms, we will post the revised version on our website with a new "Last Updated" date. Significant changes may also be communicated via email or a notice on the site. Continued use of the site or services after changes are posted constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you should stop using the site. It is your responsibility to review the Terms periodically for updates.
